Gifts of Real Estate and Private Company Shares

The 2015 federal budget proposed that, beginning in 2017, the capital gains exemption applicable to gifts of publicly traded securities be extended to gifts of the proceeds from the disposition of private company shares or real estate. However, the 2016 budget did not contain these provisions.

Real Estate

Real estate may be donated “in-kind” with the charity issuing a tax receipt for the fair market value based upon a professional appraisal. Any capital gain is subject to the usual capital gains tax. The charity may prefer that the donor sell the property and donate the proceeds, or a portion thereof, and receive a tax receipt for the cash donation.

Private Company Shares

It is possible to donate private company shares, but the valuation of the shares can be difficult under the current tax regime.  Appropriate business valuation expertise must be sought in this case.
